Italy: Constitutional Court denies access for reproductive medicine to lesbian couple

The jugdment, in Italian, is available here: EIUS – Corte costituzionale, sentenza 23 ottobre 2019, n. 221

It basically argues that Parliament is entitled to limit access to reproductive medicine according to the idea that the concept of family should IMITATE NATURE (imitatio naturae). The Court also said that as a lesbian couple cannot reproduce themselves, so even in case they are not fertile individually their possible pathologies do not really matter. Furthermore, granting them access in this case only would represent a problem in comparison to healthy lesbian couples, so the most appropriate solution is to exclude them as well.
