UN High Commissioner for Human Rights calls on Russian legislators to repeal, not expand, anti-LGBT bill

On Thursday, the Russian parliament – the State Duma – adopted proposals to broaden a ban on any discussion and sharing of information about lesbian, gay, bisexual and transgender people, and their human rights.

The UN High Commissioner for Human Rights, Volker Türk, is deeply concerned about this latest development, which infringes even further on international human rights norms and standards.

The proposals would expand an existing law from 2013, which has been extensively examined and condemned by UN human rights experts as discriminatory, violating fundamental rights to freedom of expression, and leading to an increase in hate speech, hate crimes, and abuse, including against children.

The legislative amendments worsen this situation by broadening the scope of the law to a blanket ban on all communications on the subject, including to adults. The proposals also target the rights of transgender people.

The High Commissioner appeals to legislators, who will consider the proposals in a further two readings, to reject this proposal, and to instead repeal the existing law and take urgent steps to prohibit and actively combat both discrimination and violence based on sexual orientation and gender identity.

The High Commissioner also notes that exclusion, stigmatisation and discrimination of any group within a society is corrosive, is a root cause of violence, and has a negative impact on society as a whole.

Dossier. Une « révolution des droits » LGBTQIA+ en Amérique latine ?

New publication online : Dossier. Une « révolution des droits » LGBTQIA+ en Amérique latine ? Luis Rivera-Vélez & Morgane Reina (eds.), Cahiers des Amériques Latines, 98, 2021.

This issue interrogates the notion of an LGBTQIA+ “rights revolution” in Latin America. Focusing on the temporal, spatial and structural issues of the reforms, the contributions demonstrate the limits of the radicalness and inclusiveness initially sought by LGBTQIA+ populations. The analysis of right-wing homosexual movements, the conflicts within LGBTQIA+ groups, or the lack of visibility of mobilizations on the periphery of the countries are all examples illustrating the divergent identities (and interests) of LGBTQIA+ people, the power relations between the different groups, and the unequal evolution according to the countries. This issue also builds a bridge between research conducted in Europe and Latin America, with different methodological approaches, and valuing different languages of publication.

USA: House bill proposes prohibiting use of federal funds for ‘sexual-oriented’ materials for children

Congressman Mike Johnson (R-LA) Tuesday introduced the Stop the Sexualization of Children Act. The bill would prohibit any federal, state, local or private organization from using federal funds to “expose children under 10 years of age to sexually-oriented material.” Under the bill, certain depictions or descriptions of sexual activity or any topic involving gender identity or sexual orientation would no longer receive federal funding.

Under the bill, parents and guardians would “have the right and responsibility to determine where, if, when, and how their children are exposed to material of a sexual nature.” The bill provides parents the ability to bring a civil suit for injunctive relief against any government actor who violates the limitation. Additionally, if any government actor, or private entity receiving federal funds, receives two injunctions, their federal funding will be withheld for three years.

In a statement about the bill, Johnson specifically made reference to recent pushes from Planned Parenthood to institute sexual education curricula and events where drag queens perform or read books.

Johnson said:

The Democrat Party and their cultural allies are on a misguided crusade to immerse young children in sexual imagery and radical gender ideology . . . [t]his commonsense bill is straightforward. No federal tax dollars should go to any federal, state, or local government agencies, or private organizations that intentionally expose children under 10 years of age to sexually explicit material.

Harvard Law Professor Alejandra Carabello criticized the bill saying it is a ban on any discussion of LGBTQ people in federally funded programs. She said:

I can’t overstate how radical the private right of action portion is. The bill is so broadly defined that a pediatric hospital could be sued for having a pride flag or a medical pamphlet about gender dysphoria. It deputizes anti-LGBTQ bigots to engage in bounty lawsuits.

33 other Republican representatives signed onto the bill alongside Johnson. The bill was referred to the Committee on Oversight and Reform and the Committee on Education and Labor which will determine whether the bill advances for further consideration.

LONDON (Reuters) – England’s National Health Service has drafted new guidelines for treating transgender youth that would call for local authorities to be alerted in some cases where young people have obtained puberty blockers and hormone therapies on the private market, according to a copy of the guidelines reviewed by Reuters.

Slovakia votes against more rights for LGBT couples

The Slovakian Parliament has decided to keep registration of relationships exclusively for one man and one woman only. On Wednesday, it voted against a proposal that would grant same-sex couples inheritance rights and the right to access medical records, the so-called cohabitation partnership.
